By accessing or using Headshotsmaxx ("the Service") at headshotsmaxx.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service. We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Headshotsmaxx is an AI-powered professional headshot generation service. You upload a photo, our system analyzes your facial features using Google's Gemini AI, and generates a professional headshot in your chosen style.

Headshotsmaxx offers a free preview (watermarked headshots) and a paid tier ($19.99) that unlocks full-resolution, unwatermarked headshots. We reserve the right to modify pricing, features, or discontinue the Service at any time with or without notice.

3. Your Photo: Ownership and License

You must own or have the legal right to use any photo you upload to Headshotsmaxx. By uploading a photo, you represent and warrant that:

• You are the person depicted in the photo, or you have explicit permission from the person depicted to use their likeness for this purpose
• You own the photo or have a license that permits you to use it in this manner
• Uploading and processing the photo does not violate any third party's intellectual property rights, privacy rights, or any applicable law

You grant Headshotsmaxx a limited, temporary license to process your uploaded photo solely to provide the headshot generation service. This license is non-exclusive and terminates when processing is complete. We do not claim ownership of your photo.

4. Prohibited Uses

You may not use Headshotsmaxx to:

• Upload photos of individuals under 13 years of age
• Upload photos you do not own or have rights to use
• Generate headshots intended to impersonate another person, create fraudulent identity documents, or deceive others
• Create deepfakes or synthetic media intended to mislead
• Upload photos containing illegal content, including child sexual abuse material (CSAM)
• Attempt to reverse-engineer, scrape, or systematically extract data from the Service
• Circumvent rate limits or access restrictions
• Use the Service in any way that violates applicable laws or regulations

5. AI-Generated Content

Generated headshots are produced by artificial intelligence. Results will vary based on the source photo, chosen style, and the capabilities of the underlying AI model. We do not guarantee that generated headshots will meet your specific professional requirements or expectations.

AI-generated headshots are not a substitute for professional photography in all contexts. Some employers, platforms, or publications may require photographs taken by a licensed photographer. It is your responsibility to determine whether an AI-generated headshot is appropriate for your intended use.

You own the headshots generated for you and may use them for personal and professional purposes, including LinkedIn profiles, resumes, corporate directories, and similar professional applications.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. Headshotsmaxx makes no warranty that:

• The Service will be uninterrupted, error-free, or secure
• Generated headshots will be accurate, complete, or of any particular quality
• Results will be suitable for any specific professional purpose
• Any errors or defects will be corrected

We expressly disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the fullest extent permitted by law, Headshotsmaxx and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or reputational harm — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Intellectual Property

The Headshotsmaxx name, logo, website design, and all associated software are the intellectual property of Headshotsmaxx. You may not use our branding, copy our service design, or reproduce our content without explicit written permission.

You retain all rights to your original uploaded photo. You own the AI-generated headshots produced from your photos for personal and professional use as described in Section 5.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, if we believe you have violated these Terms or are abusing the Service. Rate limiting is enforced automatically and does not constitute termination.

10. Third-Party Services

Headshotsmaxx uses Google's Gemini API to power AI features and Stripe to process payments. Your use of the Service is also subject to Google's and Stripe's respective terms of service and privacy policies. We are not responsible for their handling of data or any changes to their services that affect Headshotsmaxx.

Links to third-party websites, if any appear on our site, are provided for convenience only. We are not responsible for the content or practices of third-party sites.

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction in the United States.

12. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
